Eligibility for an Australia Fiance Visa in 2023

 

In order to be eligible for a fiancé visa, the Korean and Australian couple must have been in a ‘genuine and continuing’ relationship for at least one year, and must show evidence of this. The couple must also meet certain health and character requirements, and the Australian partner must provide a sponsorship undertaking for the South Korea Citizen. The fiancé visa application process can take several months to complete for someone from South Korea, and the visa itself is valid for 9 months. The engaged couple must marry within 9 months of the Prospective Marriage Visa being granted.

 

To prove eligibility for a Prospective Marriage Visa for Australia from South Korea, you will need to provide evidence that you and your South Korea Citizen partner are in a genuine relationship:

Subclass 300 – Prospective Marriage Visa

 

This is a temporary visa that allows the Korean fiancé of an Australian citizen or permanent resident to enter and remain in Australia for up to 9 months. During this time the couple must get married and then apply for a spouse visa to remain in Australia.

 

The requirements for the 300 visa are:

 

  • The Koreanapplicant and their Australian partner must be aged 18 or over.

  • Couple must be engaged and intend to marry within 9 months of the Koreanapplicant’s arrival in Australia

  • The couple must have met in person and be in a ‘genuine and continuing’ relationship

  • The Australian partner must be an Australian citizen or permanent resident

  • The Korean applicant must meet health and character requirements

  • The Australian partner must provide a sponsorship undertaking for their Korean partner

 

 

Subclass 309 – Partner (Provisional) Visa

 

This is a provisional visa that allows the Korean partner of an Australian citizen or permanent resident to live in Australia while they wait for a decision on their permanent partner visa. The partner must be outside of Australia (either in South Korea or elsewhere) when they apply for this visa, but can enter Australia as soon as the visa is granted. Once in Australia, the Korean applicant will have to apply for a permanent visa (subclass 100 or subclass 801) once they are eligible.

 

Requirements for the 309 visa:

 

  • The Koreanapplicant and their Australian partner must be aged 18 or over

  • They must be in a genuine and continuing relationship

  • The Australian partner must be an Australian citizen or permanent resident

  • Koreanapplicant must be outside of Australia when they apply for this visa.

  • Korean applicant must meet certain health and character requirements.

  • The Australian partner must provide a sponsorship undertaking for the Korean partner

 

To apply for this visa, the Koreanapplicant must submit a completed application form along with all required supporting documentation, including evidence of the relationship. The visa application fee must also be paid. This is a provisional temporary visa. Once the Korean applicant is in Australia, they will have to apply for a permanent partner visa (subclass 100 or subclass 801) once they are eligible to Immigrate to Australia.
